捜査協力の強化等に関する日米合同委員会合意 捜査協力の強化等に関する日米合同委員会合意 ２００４(平成16）年4月2日の日米合同委員会では、２００３(平成1５）年6月以降行われてきた日米地位協定の下での刑事裁判手続に関する日米交渉の結論として、 日米間の捜査協力の強化等に関する合同委員会合意（仮訳・英語版）（PDF）を作成した。 全文は以下の通り。 Joint Committee Agreement on Measures to Strengthen Investigative Cooperation and to Facilitate Smooth Implementation of the Joint Committee Agreement on Criminal Jurisdiction Procedures of October 25, 1995 捜査協力の強化及び１９９５年１０月２５日の刑事裁判手続きに関する 日米合同委員会合意の円滑な運用の促進のための措置に 関する日米合同委員会合意 1. As a measure to strengthen investigative cooperation between the authorities of Japan and the military authorities of the United States with regard to an offense over which the right to exercise jurisdiction is concurrent, the authorities of Japan will permit, upon request, a US command representative to be present at interrogation of an accused when: １．日本国の当局は、裁判権を行使する権利が競合する犯罪に関する日本国の当局と合衆国の軍当局との間の捜査協力を強化するための措置として、以下の場合に、要請に基づき、合衆国軍司令部の代表者が被疑者の取調べに同席することを認める。 (1) the authorities of Japan believe Japan may request the transfer of custody of the accused prior to indictment in accordance with the Joint Committee Agreement on Criminal Jurisdiction Procedures of October 25, 1995 (hereinafter referred to as the （１）日本国の当局が、１９９５年１０月２５日の刑事裁判手続きに関する日米合同委員会合意(以下「１９９５年合同委員会合意」という。）に基づく被疑者の起訴前の拘禁の移転を日本国が要請する可能性があると認める場合。 (2) custody of the accused has been transferred to Japan prior to indictment in accordance with the 1995 Joint Committee Agreement. （２）１９９５年合同委員会合意に基づき、日本国に対し被疑者の起訴前の拘禁の移転が行われた場合 2.
