CHAPTER IX. INTERNATIONAL ECONOMIC AND SOCIAL CO-OPERATION

 

    第五十五条

Article 55.

 人民の同権及び自決の原則の尊重に基礎をおく諸国間の平和的且つ友好的関係に必要な安定及び福祉の条件を創造するために,国際連合は,次のことを促進しなければならない。

a 一層高い生活水準,完全雇用並びに経済的及び社会的の進歩及び発展の条件

b 経済的,社会的及び保健的国際問題と関係国際問題の解決並ぴに文化的及ぴ教育的国際協力

c 人権,性,言語又は宗教による差別のないすべての者のための人権及び基本的自由の普遍的な尊重及び遵守

With a view to the creation of conditions of stability and well-being which are necessary for peaceful and friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, the United Nations shall promote:
(a) higher standards of living, full employment, and conditions of economic and social progress and development;
(b) solutions of international economic, social, health, and related problems; and international cultural and educational co-operation; and
(c) universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to race, sex, language, or religion.

 

    第五十六条

Article 56.

 すべての加盟国は,第五十五条に掲げる目的を達成するために,この機構と協力して,共同及び個別の行動をとることを誓約する。

All Members pledge themselves to take joint and separate action in co-operation with the Organization for the achievement of the purposes set forth in Article 55.   

 

 第五十七条

Article 57.

1 政府間の協定によって設けられる各種の専門機関で,経済的,社会的,文化的,教育的及び保健的分野並びに関係分野においてその基本的文書で定めるところにより広い国際的責任を有するものは,第六十三条の規定に従って国際連合と連携関係をもたされなければならない。

2 こうして国際連合と連携関係をもたされる前記の機関は,以下専門機関という。

(1)     The various specialized agencies, established by intergovernmental agreement and having wide international responsibilities, as defined in their basic instruments, in economic, social, cultural, educational, health, and related fields, shall be brought into relationship with the United Nations in accordance with the provisions of Article 63.
(2) Such agencies thus brought into relationship with the United Nations are hereinafter referred to as specialized agencies.

 

    第五十八条

Article 58.

この機構は,専門機関の政策及び活動を調整するために勧告をする。

The Organization shall make recommendations for the co-ordination of the policies and activities of the specialized agencies.    

 

第五十九条

Article 59.

この機構は,適当な場合には,第五十五条に掲げる目的の達成に必要な新たな専門機関を設けるために関係国間の交渉を発議する。

The Organization shall, where appropriate, initiate negotiations among the states concerned for the creation of any new specialized agencies required for the accomplishment of the purposes set forth in Article 55.

 

    第六十条

Article 60.

この章に掲げるこの機構の任務を果たす責任は,総会及び,総会の権威の下に,経済社会理事会に課せられる。理事会は,このために第十章に掲げる権限を有する。

Responsibility for the discharge of the functions of the Organization set forth in this Chapter shall be vested in the General Assembly and, under the authority of the General Assembly, in the Economic and Social Council, which shall have for this purpose the powers set forth in Chapter X.

 

  

第十章      経済社会理事会

CHAPTER X. THE ECONOMIC AND SOCIAL COUNCIL

 

構成 Composition

    第六十一条(注3)

Article 61.*c*

1 経済社会理事会は,総会によって選挙される十八の国際連合加盟国で構成する。

2 3の規定を留保して,経済社会理事会の六理事国は,三年の任期で毎年選挙される。退任理事国は,引き続いて再選される資格がある。

3 第一回の選挙では,経済社会理事会の十八理事国が選ばれる。こうして選ばれるもののうち,六理事国の任期は一年の終に,他の六理事国の任期は二年の終に,総会の定める取極に従って終了する。

 4 経済社会理事会の各理事国は,一人の代表者を有する。

 (1) The Economic and Social Council shall consist of eighteen Members of the United Nations elected by the General Assembly.
(2) Subject to the provisions of paragraph 3, six members of the Economic and Social Council shall be elected each year for a term of three years. A retiring member shall be eligible for immediate re-election.
(3) At the first election, eighteen members of the Economic and Social Council shall be chosen. The term of office of six members so chosen shall expire at the end of one year, and of six other members at the end of two years, in accordance with arrangements made by the General Assembly.
(4) Each member of the Economic and Social Council shall have one representative.

 

任務及び権限 Functions and Powers

    第六十ニ条

Article 62

1 経済社会理事会は,経済的,社会的,文化的,教育的及び保健的国際事項並びに関係国際事項に関する研究及び報告を行い,又は発議し,並びにこれらの事項に関して総会,国際連合加盟国及び関係専門機関に勧告をすることができる。

2 理事会は,すべての者のための人椎及び基本的自由の尊重及ぴ遵守を助長するために,勧告をすることができる。

3 理車会は,その権限に属する事項について,総会に堤出するための条約案を作成することができる

4 理事会は,国際連合の定める規則に従って,その権限に属する事項について国際会議を招集することができる。

(1) The Economic and Social Council may make or initiate studies and reports with respect to international economic, social, cultural, educational, health, and related matters and may make recommendations with respect to any such matters to the General Assembly, to the Members of the United Nations, and to the specialized agencies concerned.
(2) It may make recommendations for the purpose of promoting respect for, and observance of, human rights and fundamental freedoms for all.
(3) It may prepare draft conventions for submission to the General Assembly, with respect to matters falling within its competence.
(4) It may call, in accordance with the rules prescribed by the United Nations, international conferences on matters falling within its competence.

 

    第六十三条

Article 63.

1 経済社会理事会は,第五十七条に掲げる機関のいずれとの関にも,その機関が国際連合と連携関係をもたされるについての条件を定める協定を締結することができる。この協定は,総会の承認を受けなければならない。

2 理事会は,専門機関との協議及び専門機関に対する勧告並びに総会及ぴ国際連合加盟国に対する勧告によって,専門機関の活動を調整することができる。

 (1) The Economic and Social Council may enter into agreements with any of the agencies referred to in Article 57, defining the terms on which the agency concerned shall be brought into relationship with the United Nations. Such agreements shall be subject to approval by the General Assembly.
(2) It may co-ordinate the activities of the specialized agencies through consultation with and recommendations to such agencies and through recommendations to the General Assembly and to the Members of the United Nations.

 

    第六十四条

Article 64.

1 経済社会理事会は,専門機関から定期報告を受けるために,適当な措置をとることができる。理事会は,理事会の勧告と理事会の権限に属する事項に関する総会の勧告とを実施するためにとられた措置について報告を受けるため,国際連合加盟国及び専門機関と取極を行うことができる。

2 理事会は,前期の報告に関するその意見を総会に通報することができる。

(1)     The Economic and Social Council may take appropriate steps to obtain regular reports from the specialized agencies. It may make arrangements with the Members of the United Nations and with the specialized agencies to obtain reports on the steps taken to give effect to its own recommendations and to recommendations on matters falling within its competence made by the General Assembly.
(2) It may communicate its observations on these reports to the General Assembly.

Article 65.

 経済社会理事会は,安全保障理事会に情報を提供することができる。経済社会理事会は,また,安全保障理事会の要請があったときは,これを援助しなければならない。

The Economic and Social Council may furnish information to the Security Council and shall assist the Security Council upon its request.

 

    第六十六条

Article 66.

1 経済社会理事会は,総会の勧告の履行に関して,自己の権限に属する任務を遂行しなければならない。

 2 理事会は,国際連合加盟国の要請があつたとき,又は専門機関の要請があつたときは,総会の承認を得て役務を提供することができる。

3 理事会は,この憲章の他の箇所に定められ,又は総会によって自己に与えられるその他の任務を遂行しなければならない。 

(1) The Economic and Social Council shall perform such functions as fall within its competence in connexion with the carrying out of the recommendations of the General Assembly.
(2) It may, with the approval of the General Assembly, perform services at the request of Members of the United Nations and at the request of specialized agencies.
(3) It shall perform such other functions as are specified elsewhere in the present Charter or as may be assigned to it by the General Assembly.

    第六十七条

Article 67.

1 経済社会理事会の各理事国は,一個の投票権を有する。

2 経済社会理事会の決定は,出席し且つ投票する理事国の過半数によって行われる。

(1)     Each member of the Economic and Social Council shall have one vote.

(2)     Decisions of the Economic and Social Council shall be made by a majority of the members present and voting.

 

手続Procedure

    第六十八条

Article 68.

経済社会理事会は,経済的及び社会的分野における委員会,人権の伸張に関する委員会並びに自己の任務の遂行に必要なその他の委員会を設ける。

The Economic and Social Council shall set up commissions in economic and social fields and for the promotion of human rights, and such other commissions as may be required for the performance of its functions.

 

    第六十九条

Article 69.

経済社会理事会は,いずれの国際連合加盟国に対しても,その加盟国に特に関係のある事項についての審議に投票権なしで参加するように勧誘しなければならない。

The Economic and Social Council shall invite any Member of the United Nations to participate, without vote, in its deliberations on any matter of particular concern to that Member.

 

    第七十条

Article 70.

経済社会理事会は,専門機関の代表者が理事会の審議及び理事会の設ける委員会の審議に投票権なしで参加するための取極並びに理事会の代表者が専門機関の審議に参加するための取極を行うことができる。

The Economic and Social Council may make arrangements for representatives of the specialized agencies to participate, without vote, in its deliberations and in those of the commissions established by it, and for its representatives to participate in the deliberations of the specialized agencies.

 

    第七十一条

Article 71.

経済社会理事会は,その権限内にある事項に関係のある民間団体と協議するために,適当な取極を行うことができる。この取極は,国際団体との間に,また,適当な場合には,関係のある国際連合加盟国と協議した後に国内団体との間に行うことができる。

The Economic and Social Council may make suitable arrangements for consultation with non-governmental organizations which are concerned with matters within its competence. Such arrangements may be made with international organizations and, where appropriate, with national organizations after consultation with the Member of the United Nations concerned.  

 

  第七十二条

Article 72.

1 経済社会理事会は,議長を選定する方法を含むその手続規則を採択する。 

 2 経済社会理事会は,その規則に従って必要があるときに会合する。この規則は,理事国の過半数の要請による会議招集の規定を含まなければならない。

(1)     The Economic and Social Council shall adopt its own rules of procedure, including the method of selecting its President.
(2) The Economic and Social Council shall meet as required in accordance with its rules, which shall include provision for the convening of meetings on the request of a majority of its members.

 

11非自治地域に関する宣言
CHAPTER XI. DECLARATION REGARDING NON-SELF-G0VERNING TERRITORIES

 

    第七十三条

Article 73.

人民がまだ完全には自治を行うに至つていない地域の施政を行う責任を有し,又は引き受ける国際連合加盟国は,この地域の住民の利益が至上のものであるという原則を承認し,且つ,この地域の住民の福祉をこの憲章の確立する国際の平和及び安全の制度内で最高度まで増進する義務並びにそのために次のことを行う義務を神聖な信託として受諾する。

Members of the United Nations which have or assume responsibilities for the administration of territories whose peoples have not yet attained a full measure of self-government recognize the principle that the interests of the inhabitants of these territories are paramount, and accept as a sacred trust the obligation to promote to the utmost, within the system of international peace and security established by the present Charter, the well-being of the inhabitants of these territories, and, to this end:

a 関係人民の文化を十分に尊重して,この人民の政治的,経済的,社会的及び教育的進歩,公正な待遇並びに虐待からの保護を確保すること。

 b 各地域及びその人民の特殊事情並びに人民の進歩の異なる段階に応じて,自治を発達させ,人民の政治的願望に妥当な考慮を払い,且つ,人民の自由な政治制度の漸進的発達について人民を援助すること。

 c 国際の平和及び安全を増進すること。

 d 本条に掲げる社会的,経済的及び科学的目的を実際に達成するために,建設的な発展措置を促進し,研究を奨励し,且つ,相互に及び適当な場合には専門国際団体と協力すること。

 e 第十二章及び第十三章の適用を受ける地域を除く外,前記の加盟国がそれぞれ責任を負う地域における経済的,社会的及び教育的状態に関する専門的性質の統計その他の資料を,安全保障及び憲法上の考慮から必要な制限に従うことを条件として,情報用として事務総長に定期的に送付すること。

(a)     to ensure, with due respect for the culture of the peoples concerned, their political, economic, social, and educational advancement, their just treatment, and their protection against abuses;
(b) to develop self-government, to take due account of the political aspirations of the peoples, and to assist them in the progressive development of their free political institutions, according to the particular circumstances of each territory and its peoples and their varying stages of advancement;
(c) to further international peace and security;
(d) to promote constructive measures of development, to encourage research, and to co-operate with one another and, when and where appropriate, with specialized international bodies with a view to the practical achievement of the social, economic, and scientific purposes set forth in this Article; and
(e) to transmit regularly to the Secretary-General for information purposes, subject to such limitation as security and constitutional considerations may require, statistical and other information of a technical nature relating to economic, social, and educational conditions in the territories for which they are respectively responsible other than those territories to which Chapters XII and XIII apply.

 

    第七十四条

Article 74.

 国際連合加盟国は,また,本章の適用を受ける地域に関するその政策を,その本土に関する政策と同様に,世界の他の地域の利益及び福祉に妥当な考慮を払った上で,社会的,経済的及び商業的事項に関して善隣主義の一般原則に基かせなければならないことに同意する。

Members of the United Nations also agree that their policy in respect of the territories to which this Chapter applies, no less than in respect of their metropolitan areas, must be based on the general principle of good neighbourliness, due account being taken of the interests and well-being of the rest of the world, in social, economic, and commercial matters.

 

 

第十二章 国際信託統治制度

CHAPTER XII. INTERNATIONAL TRUSTEESHIP SYSTEM  

 

  第七十五条

Article 75.

 国際連合は,その権威の下に,国際信託統治制度を設ける。この制度は,今後の個々の協定によってこの制度の下におかれる地域の施政及び監督を目的とする。この地域は,以下信託統治地域という。

The United Nations shall establish under its authority an international trusteeship system for the administration and supervision of such territories as may be placed thereunder by subsequent individual agreements. These territories are hereinafter referred to as trust territories.

 

    第七十六条

Article 76.

信託統治制度の基本目的は,この憲章の第一条に掲げる国際連合の目的に従って,次のとおりとする。

a 国際の平和及び安全を増進すること。

b 信託統治地城の住民の政治的,経済的,社会的及び教育的進歩を促進すること。各地城及びその人民の特殊事情並びに関係人民が自由に表明する願望に適合するように,且つ,各信託統治協定の条項が規定するところに従って,自治又は独立に向つての住民の漸進的発達を促進すること。

c 人種,性,言語又は宗教による差別なくすべての者のために人権及び基本的自由を尊重するように奨励し,且つ,世界の人民の相互依存の認識を助長すること。

d 前記の目的の達成を妨げることなく,且つ,第八十条の規定を留保して,すべての国際連合加盟国及びその国民のために社会的,経済的及び商業的事項について平等の待遇を確保し,また,その国民のために司法上で平等の待遇を確保すること。

The basic objectives of the trusteeship system, in accordance with the Purposes of the United Nations laid down in Article 1 of the present Charter, shall be:
(a) to further international peace and security;
(b) to promote the political, economic, social, and educational advancement of the inhabitants of the trust territories, and their progressive development towards self-government or independence as may be appropriate to the particular circumstances of each territory and its peoples and the freely expressed wishes of the peoples concerned, and as may be provided by the terms of each trusteeship agreement;
(c) to encourage respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion, and to encourage recognition of the interdependence of the peoples of the world; and
(d) to ensure equal treatment in social, economic, and commercial matters for all Members of the United Nations and their nationals, and also equal treatment for the latter in the administration of justice, without prejudice to the attainment of the foregoing objectives and subject to the provisions of Article 80.

 

    第七十七条

Article 77.

1 信託統治制度は,次の種類の地域で信託統治協定によってこの制度の下におかれるものに適用する。

a 現に委任統治の下にある地域

b 第二次世界戦争の結果として敵国から分離される地域

c 施政について責任を負う国によって自発的にこの制度の下におかれる地域2 前記の種類のうちのいずれの地域がいかなる条件で信託統治制度の下におかれるかについては,今後の協定で定める。

(1)     The trusteeship system shall apply to such territories in the following categories as may be placed thereunder by means of trusteeship agreements:
(a) territories now held under mandate;
(b) territories which may be detached from enemy states as a result of the Second World War; and
(c) territories voluntarily placed under the system by states responsible for their administration.
(2) It will be a matter for subsequent agreement as to which territories in the foregoing categories will be brought under the trusteeship system and upon what terms.

 

    第七十八条

Article 78.

国際連合加盟国の間の開係は,主権平等の原則の尊重を基礎とするから,信託統治制度は,加盟国となった地域には適用しない。

The trusteeship system shall not apply to territories which have become Members of the United Nations, relationship among which shall be based on respect for the principle of sovereign equality.

 

    第七十九条

Article 79.

信託統治制度の下におかれる各地域に関する信託統治の条項は,いかなる変更又は改正も含めて,直接関係国によって協定され,且つ,第八十三条及び第八十五条に規定するところに従って承認されなければならない。この直接関係国は,国際連合加盟国の委任統治の下にある地城の場合には,受任国を含む。

The terms of trusteeship for each territory to be placed under the trusteeship system, including any alteration or amendment, shall be agreed upon by the states directly concerned, including the mandatory power in the case of territories held under mandate by a Member of the United Nations, and shall be approved as provided for in Articles 83 and 85.

    第八十条

Article 80.

1 第七十七粂,第七十九条及び第八十一条に基いて締結され,各地域を信託統治制度の下におく個々の信託統治協定において協定されるところを除き,また,このような協定が締結される時まで,本章の規定は,いずれの国又はいずれの人民のいかなる権利をも,また,国際連合加盟国がそれぞれ当事国となっている現存の国際文書の条項をも,直接又は間接にどのようにも変更するものと解釈してはならない。

 

2 本条1は,第七十七条に規定するところに従って委任統治地域及びその他の地城を信託統治制度の下におくための協定の交渉及び締結の遅滞又は延期に対して,根拠を与えるものと解釈してはならない。

(1) Except as may be agreed upon in individual trusteeship agreements, made under Articles 77, 79, and 81, placing each territory under the trusteeship system, and until such agreements have been concluded, nothing in this Chapter shall be construed in or of itself to alter in any manner the rights whatsoever of any states or any peoples or the terms of existing international instruments to which Members of the United Nations may respectively be parties.
(2) Paragraph 1 of this Article shall not be interpreted as giving grounds for delay or postponement of the negotiation and conclusion of agreements for placing mandated and other territories under the trusteeship system as provided for in Article 77.

 

    第八十一条

Article 81.

信託統治協定は,各場合において,信託統治地域の施政を行うについての条件を含み,且つ,信託統治地城の施政を行う当局を指定しなければならない。この当局は,以下施政権者といい,一若しくは二以上の国又はこの機構自身であることができる。

The trusteeship agreement shall in each case include the terms under which the trust territory will be administered and designate the authority which will exercise the administration of the trust territory. Such authority, hereinafter called the administering authority, may be one or more states or the Organization itself.

 

    第八十二条

Article 82

いかなる信託統治協定においても,その協定が適用される信託統治地城の一部又は全部を含む一又は二以上の戦略地区を指定することができる。但し,第四十三条に基いて締結される特別協定を害してはならない。

. There may be designated, in any trusteeship agreement, a strategic area or areas which may include part or all of the trust territory to which the agreement applies, without prejudice to any special agreement or agreements made under Article 43.

    第八十三条

Article 83.

1 戦略地区に関する国際連合のすべての任務は,信託統治協定の条項及びその変更又は改正の承認を含めて,安全保陣理事会が行う。 

2 第七十六条に掲げる基本目的は,各戦略地区の人民に適用する。

3 安全保障理事会は,国際連合の信託統治制度に基く任務で戦略地区の政治的,経済的,社会的及び教育的事項に関するものを遂行するために,信託統治理事会の援助を利用する。但し,信託統治協定の規定には従うものとし,また,安全保障の考慮が妨げられてはならない。

 (1) All functions of the United Nations relating to strategic areas, including the approval of the terms of the trusteeship agreements and of their alteration or amendment, shall be exercised by the Security Council.
(2) The basic objectives set forth in Article 76 shall be applicable to the people of each strategic area.
(3) The Security Council shall, subject to the provisions of the trusteeship agreements and without prejudice to security considerations, avail itself of the assistance of the Trusteeship Council to perform those functions of the United Nations under the trusteeship system relating to political, economic, social, and educational matters in the strategic areas.

 

    第八十四条

Article 84.

信託統治地城が国際の平和及び安全の維持についてその役割を果すようにすることは,施政権者の義務である。このため,施政権者は,この点に関して安全保障理事会に対して負う義務を履行するに当って,また,地方的防衛並びに信託統治地域における法律及び秩序の維持のために,信託統治地域の義勇軍,便益及び援助を利用することができる。

It shall be the duty of the administering authority to ensure that the trust territory shall play its part in the maintenance of international peace and security. To this end the administering authority may make use of volunteer forces, facilities, and assistance from the trust territory in carrying out the obligations towards the Security Council undertaken in this regard by the administering authority, as well as for local defence and the maintenance of law and order within the trust territory.

 

    第八十五条

Article 85.

1 戦略地区として指定されないすべての地区に関する信託統治協定についての国際連合の任務は,この協定の条項及びその変更又は改正の承認を含めて,総会が行う。

2 総会の権威の下に行動する信託統治理事会は,前記の任務の遂行について総会を援功する。

(1) The functions of the United Nations with regard to trusteeship agreements for all areas not designated as strategic, including the approval of the terms of the trusteeship agreements and of their alteration or amendment, shall be exercised by the General Assembly.
(2) The Trusteeship Council, operating under the authority of the General Assembly, shall assist the General Assembly in carrying out these functions.

 

 

第十二章 信託統治理事会

CHAPTER XIII. THE TRUSTEESHIP COUNCIL

 

構成 Composition

    第八十六条

Article 86.

1 信託統治理事会は,次の国際連合加盟国で構成する。

 

a 信託統治地域の施政を行う加盟国

b 第二十三条に名を掲げる加盟国で信託統治の施政を行っていないもの。

c 総会によって三年の任期で選挙されるその他の加盟国。その数は,信託統治理事会の理事国の総数を,信託統治地城の施政を行う国際連合加盟国とこれを行っていないものとの間に均分するのに必要な数とする。

2 信託統治理事会の各理事国は,理事会で自国を代表する特別の資格を有する者一人を指名しなければならない。

 (1) The Trusteeship Council shall consist of the following Members of the United Nations:
(a) those Members administering trust territories;
(b) such of those Members mentioned by name in Article 23 as are not administering trust territories; and
(c) as many other Members elected for three-year terms by the General Assembly as may be necessary to ensure that the total number of members of the Trusteeship Council is equally divided between those Members of the United Nations which administer trust territories and those which do not.
(2) Each member of the Trusteeship Council shall designate one specially qualified person to represent it therein.

任務及び権限 Functions and Powers

    第八十七条

Article 87.

総会及びその権威の下に,信託統治理事会は,その任務の遂行に当って次のこ

とを行うことができる。

a 施政権者の提出する報告を審議すること。

b 請願を受理し,且つ,施政権者と協議してこれを審査すること。

c 施政権者と協定する時期に,それぞれの信託統治地域の定期視察を行わせること。

d 信託統治協定の条項に従って,前記の行動その他の行動をとること。

The General Assembly and, under its authority, the Trusteeship Council, in carrying out their functions, may:
(a) consider reports submitted by the administering authority;
(b) accept petitions and examine them in consultation with the administering authority;
(c) provide for periodic visits to the respective trust territories at times agreed upon with the administering authority; and
(d) take these and other actions in conformity with the terms of the trusteeship agreements.

    第八十八条

Article 88.

 信託統治理事会は,各信託統治地域の住民の政治的,経済的,社会的及び教育的進歩に関する質問書を作成しなければならない。また,総会の権限内にある各信託統治地域の施政権者は,この質問書に基いて,総会に年次報告を提出しなければならない。 

The Trusteeship Council shall formulate a questionnaire on the political, economic, social, and educational advancement of the inhabitants of each trust territory, and the administering authority for each trust territory within the competence of the General Assembly shall make an annual report to the General Assembly upon the basis of such questionnaire.

    第八十九条

Article 89.

 

1 信託統治理事会の各理事国は,一個の投票権を有する。

2 信託統治理事会の決定は,出席し且つ投票する理事国の過半数によって行われる。

Article 89. (1) Each member of the Trusteeship Council shall have one vote.
(2) Decisions of the Trusteeship Council shall be made by a majority of the members present and voting.

 

手続Procedure

Article 90.

1 信託統治理事会は,議長を選定する方法を含むその手続規則を採択する。

2 信託統治理事会は,その規則に従って必要があるときに会合する。この規則は,理事国の過半数の要請による会議招集の規定を含まなければならない。

Article 90. (1) The Trusteeship Council shall adopt its own rules of procedure, including the method of selecting its President.
(2) The Trusteeship Council shall meet as required in accordance with its rules, which shall include provision for the convening of meetings on the request of a majority of its members.

    第九十一条 

Article 91.

 信託統治理事会は,適当な場合には,経済社会理事会及び専門機関がそれぞれ関係している事項について,両者の援助を利用する。

The Trusteeship Council shall, when appropriate, avail itself of the assistance of the Economic and Social Council and of the specialized agencies in regard to matters with which they are respectively concerned.  

 

第十四章 国際司法裁判所

CHAPTER XIV. THE INTERNATIONAL COURT OF JUSTICE

 

    第九十二条

Article 92.

国際司法裁判所は,国際連合の主要な司法機関である。この裁判所は,附属の規程に従って任務を行う。この規程は,常設国際司法裁判所規程を基礎とし,且つ,この憲章と不可分の一体をなす。

The International Court of Justice shall be the principal judicial organ of the United Nations. It shall function in accordance with the annexed Statute, which is based upon the Statute of the Permanent Court of International Justice and forms an integral part of the present Charter.

 

    第九十三条

Article 93.

1 すべての国際連合加盟国は,当然に,国際司法裁判所規程の当事国となる。

2 国際連合加盟国でない国は,安全保障理事会の勧告に基いて総会が各場合に決定する条件で国際司法裁判所規程の当事国となることができる。

(1) All Members of the United Nations are ipso facto parties to the Statute of the International Court of Justice.
(2) A state which is not a Member of the United Nations may become a party to the Statute of the International Court of Justice on conditions to be determined in each case by the General Assembly upon the recommendation of the Security Council.

 

    第九十四条

Article 94.

1 各国際連合加盟国は,自国が当事者であるいかなる事件においても,国際司法裁判所の裁判に従うことを約束する。

2 事件の一方の当事者が裁判所の与える判決に基いて自国が負う義務を履行しないときは,他方の当事者は,安全保陣理事会に訴えることができる。理事会は,必要と認めるときは,判決を執行するために勧告をし,又はとるべき措置を決定することができる。

(1)     Each Member of the United Nations undertakes to comply with the decision of the International Court of Justice in any case to which it is a party.

(2)     If any party to a case fails to perform the obligations incumbent upon it under a judgement rendered by the Court, the other party may have recourse to the Security Council, which may, if it deems necessary, make recommendations or decide upon measures to be taken to give effect to the judgement.

 

    第九十五条

Article 95.

この憲章のいかなる規定も,国際連合加盟国が相互間の紛争の解決を既に存在し又は将来締結する協定によって他の裁判所に付託することを妨げるものではない。

Nothing in the present Charter shall prevent Members of the United Nations from entrusting the solution of their differences to other tribunals by virtue of agreements already in existence or which may be concluded in the future.

 

    第九十六条

Article 96.

1 総会又は安全保障理事会は,いかなる法律問題についても勧告的意見を与えるように国際司法裁判所に要請することができる。

2 国際連合のその他の機関及び専門機関でいずれかの時に総会の許可を得るものは,また,その活動の範囲内において生ずる法律問題について裁判所の勧告的意見を要請することができる。

(1)     The General Assembly or the Security Council may request the International Court of Justice to give an advisory opinion on any legal question.
(2) Other organs of the United Nations and specialized agencies, which may at any time be so authorized by the General Assembly, may also request advisory opinions of the Court on legal questions arising within the scope of their activities.

 

 

第十五章 事務局

CHAPTER XV. THE SECRETARIAT

 

    第九十七条

Article 97.

事務局は,一人の事務総長及びこの機構が必要とする職員からなる。事務総長は,安全保障理事会の勧告に基いて総会が任命する。事務総長は,この機構の行政職員の長である。

The Secretariat shall comprise a Secretary-General and such staff as the Organization may require. The Secretary-General shall be appointed by the General Assembly upon the recommendation of the Security Council. He shall be the chief administrative officer of the Organization.

Article 98.

事務総長は,総会,安全保障理事会,経済社会理事会及び信託統治理事会のすべての会議において事務総長の資格で行動し,且つ,これらの機関から委託される他の任務を遂行する。事務総長は,この機構の事業について総会に年次報告を行う。

The Secretary-General shall act in that capacity in all meetings of the General Assembly, of the Security Council, of the Economic and Social Council, and of the Trusteeship Council, and shall perform such other functions as are entrusted to him by these organs. The Secretary-General shall make an annual report to the General Assembly on the work of the Organization.

 

    第九十九条

Article 99.

事務総長は,国際の平和及び安全の維持を脅威すると認める事項について,安全保障理事会の注意を促すことができる。

The Secretary-General may bring to the attention of the Security Council any matter which in his opinion may threaten the maintenance of international peace and security.

 

    第百条

Article 100.

1 事務総長及び職員は,その任務の遂行に当って,いかなる政府からも又はこの機構外のいかなる他の当局からも指示を求め,又は受けてはならない。事務総長及び職員は,この機構に対してのみ責任を負う国際的職員としての地位を損ずる虞のあるいかなる行動も慎まなければならない。

2 各国際連合加盟国は,事務総長及び職員の責任のもっぱら国際的な性質を尊重すること並びにこれらの者が責任を果すに当ってこれらの者を左右しようとしないことを約束する。

(1)     In the performance of their duties the Secretary-General and the staff shall not seek or receive instructions from any government or from any other authority external to the Organization. They shall refrain from any action which might reflect on their position as international officials responsible only to the Organization.
(2) Each Member of the United Nations undertakes to respect the exclusively international character of the responsibilities of the Secretary-General and the staff and not to seek to influence them in the discharge of their responsibilities.

 

    第百一条

Article 101.

1 職員は,総会が設ける規則に従って事務総長が任命する。

2 経済社会理事会,信託統治理事会及び,必要に応じて,国際連合のその他の機関に,適当な職員を常任として配属する。この職員は,事務局の一部をなす。

3 職員の雇用及び勤務条件の決定に当って最も考慮すべきことは,最高水準の能率,能力及び誠実を碓保しなければならないことである。職員をなるべく広い地理的基礎に基いて採用することの重要性については,妥当な考慮を払わなければならない。

 (1) The staff shall be appointed by the Secretary-General under regulations established by the General Assembly.
(2) Appropriate staffs shall be permanently assigned to the Economic and Social Council, the Trusteeship Council, and, as required, to other organs of the United Nations. These staffs shall form a part of the Secretariat.
(3) The paramount consideration in the employment of the staff and in the determination of the conditions of service shall be the necessity of securing the highest standards of efficiency, competence, and integrity. Due regard shall be paid to the importance of recruiting the staff on as wide a geographical basis as possible.

 

 

第十六章 雑則

CHAPTER XVI. MISCELLANEOUS PROVISIONS

 

    第百二条

Article 102.

1 この憲章が効力を生じた後に国際連合加盟国が締結するすべての条約及びすべての国際協定は,なるべくすみやかに事務局に登録され,且つ,事務局によって公表されなければならない。

2 前記の条約又は国際協定で本条1の規定に従って登録されていないものの当事国は,国際連合のいかなる機関に対しても当該条約又は協定を援用することができない。

 (1) Every treaty and every international agreement entered into by any Member of the United Nations after the present Charter comes into force shall as soon as possible be registered with the Secretariat and published by it.
(2) No party to any such treaty or international agreement which has not been registered in accordance with the provisions of paragraph 1 of this Article may invoke that treaty or agreement before any organ of the United Nations.

 

    第百三条

Article 103.

国際連合加盟国のこの憲章に基く義務と他のいずれかの国際協定に基く義務とが抵触するときは,この憲章に基く義務が優先する。

In the event of a conflict between the obligations of the Members of the United Nations under the present Charter and their obligations under any other international agreement, their obligations under the present Charter shall prevail.

 

    第百四条

Article 104.

 この機構は,その任務の遂行及びその目的の達成のために必要な法律上の能力を各加盟国の領域において享有する。

The Organization shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes.

Article 105.

1 この機構は,その目的の達成に必要な特権及び免除を各加盟国の領域において享有する。

2 これと同様に,国際連合加盟国の代表者及びこの機構の職員は,この機構に関連する自己の任務を独立に遂行するために必要な特権及び免除を享有する。

3 総会は,本条1及び2の適用に関する細目を決定するために勧告をし,又はそのために国際連合加盟国に条約を提案することができる。

(1) The Organization shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the fulfilment of its purposes.
(2) Representatives of the Members of the United Nations and officials of the Organization shall similarly enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connexion with the Organization.
(3) The General Assembly may make recommendations with a view to determining the details of the application of paragraphs I and 2 of this Article or may propose conventions to the Members of the United Nations for this purpose.

 

 

第十七章 安全保障の過渡的規定

CHAPTER XVII. TRANSITIONAL SECURITY ARRANGEMENTS

 

    第百六条

Article 106.

第四十三条に掲げる特別協定でそれによって安全保障理事会が第四十二条に基く責任の遂行を開始することができると認めるものが効力を生ずるまでの関,千九百四十三年十月三十日にモスコーで署名された四国宣言の当事国及びフランスは,この宣言の第五項の規定に従って,国際の平和及び安全の維持のために必要な共同行動をこの機構に代ってとるために相互に及び必要に応じて他の国際連合加盟国と協議しなければならない。

Pending the coming into force of such special agreements referred to in Article 43 as in the opinion of the Security Council enable it to begin the exercise of its responsibilities under Article 42, the parties to the Four-Nation Declaration, signed at Moscow, 30 October 1943, and France, shall, in accordance with the provisions of paragraph 5 of that Declaration, consult with one another and as occasion requires with other Members of the United Nations with a view to such joint action on behalf of the Organization as may be necessary for the purpose of maintaining international peace and security.

 

    第百七条

Article 107.

この憲章のいかなる規定も,第二次世界戦争中にこの憲章の署名国の敵であった国に関する行動でその行動について責任を有する政府がこの戦争の結果としてとり又は許可したものを無効にし,又は排除するものではない。

Nothing in the present Charter shall invalidate or preclude action, in relation to any state which during the Second World War has been an enemy of any signatory to the present Charter, taken or authorized as a result of that war by the Governments having responsibility for such action.

 

第十八章 改正

CHAPTER XVIII. AMENDMENTS

 

    第百八条

Article 108.

 この憲章の改正は,総会の構成国の三分の二の多数で採択され,且つ,安全保障理事会のすべての常任理事国を含む国際連合加盟国の三分の二によって各自の憲法上の手続きに従って批准された時に,すべての国際連合加盟国に対して効力を生ずる。

Amendments to the present Charter shall come into force for all Members of the United Nations when they have been adopted by a vote of two thirds of the members of the General Assembly and ratified in accordance with their respective constitutional processes by two thirds of the Members of the United Nations, including all the permanent members of the Security Council.

1 この憲章を再審議するための国際連合加盟国の全体会議は,総会の構成国の三分の二の多数及び安全保障理事会の七理事国の投票によって決定される日及び場所で開催することができる。各国際連合加盟国は,この会議において一個の投票権を有する。

(1)     A General Conference of the Members of the United Nations for the purpose of reviewing the present Charter may be held at a date and place to be fixed by a two-thirds vote of the members of the General Assembly and by a vote of any seven members of the Security Council. Each Member of the United Nations shall have one vote in the conference.
(2) Any alteration of the present Charter recommended by a two-thirds vote of the conference shall take effect when ratified in accordance with their respective constitutional processes by two thirds of the Members of the United Nations including all the permanent members of the Security Council.
(3) If such a conference has not been held before the tenth annual session of the General Assembly following the coming into force of the present Charter, the proposal to call such a conference shall be placed on the agenda of that session of the General Assembly, and the conference shall be held if so decided by a majority vote of the members of the General Assembly and by a vote of any seven members of the Security Council.

 

第十九章 批准及び署名

CHAPTER XIX. RATIFICATION AND SIGNATURE

 

    第百十条

Article 110.

1 この憲章は,署名国によって各自の憲法上の手続に従って批准されなければならない。

2 批准書は,アメリカ合衆国政府に寄託される。同政府は,すべての署名国及び,この機構の事務総長が任命された場合には,事務総長に対して各寄託を通告する。

3 この憲章は,中華民国,フランス,ソヴィエト社会主義共和国連邦,グレート・ブリテン及び北部アイルランド連合王国,アメリカ合衆国及びその他の署名国の過半数が批准書を寄託した時に効力を生ずる。批准書寄託調書は,その時にアメリカ合衆国政府が作成し,その謄本をすべての署名国に送付する。

4 この憲章の署名国で憲章が効力を生じた後に批准するものは,各自の批准書の寄託の日に国際連合の原加盟国となる。

(1) The present Charter shall be ratified by the signatory states in accordance with their respective constitutional processes.
(2) The ratifications shall be deposited with the Government of the
United States of America, which shall notify all the signatory states of each deposit as well as the Secretary-General of the Organization when he has been appointed.
(3) The present Charter shall come into force upon the deposit of ratifications by the Republic of China,
France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern lreland, and the United States of America, and by a majority of the other signatory states. A protocol of the ratifications deposited shall thereupon be drawn up by the Government of the United States of America which shall communicate copies thereof to all the signatory states.
(4) The states signatory to the present Charter which ratify if after it has come into force will become original Members of the United Nations on the date of the deposit of their respective ratifications.

Article 111.

この憲章は,中国語,フランス語,ロシア語,英語及びスペイン語の本文をひとしく正文とし,アメリカ合衆国政府の記録に寄付しておく。この憲章の認証謄本は,同政府が他の署名国の政府に送付する。

The present Charter, of which the Chinese, French, Russian, English, and Spanish texts are equally authentic, shall remain deposited in the archives of the Government of the United States of America. Duly certified copies thereof shall be transmitted by that Government to the Governments of the other signatory states.

 

以上の証拠として,連合国政府の代表者は,この憲章に署名した。

The Charter of the United Nations was signed on 26 June 1945, in San

Francisco, at the conclusion of the United Nations Conference on

International Organization, and came into force on 24 October 1945. The

Statute of the International Court of Justice is an integral part of the

Charter.Amendments to Articles 23, 27 and 61 of the Charter were adopted by

the General Assembly on 17 December 1963 and came into force on 31 August

1965. A further amendment to Article 61 was adopted by the General Assembly

on 20 December 1971, and came into force on 24 September 1973. An amendment

to Article 109, adopted by the General Assembly on 20 December 1965, came

into force on 12 June 1968. The

amendment to Article 23 enlarges the membership of the Security Council from

eleven to fifteen. The amended Article 27 provides that decisions of the

Security Council on procedural matters shall be made by an affirmative vote

of nine members (formerly seven) and on all other matters by an affirmative

vote of nine members (formerly seven), including the concurring votes of the

five permanent members of the Security Council. The

amendment to Article 61, which entered into force on 31 August 1965,

enlarged the membership of the Economic and Social Council from eighteen to

twenty-seven. The subsequent amendment to that Article, which entered into

force on 24 September 1973, further increased the membership of the Council

from twenty-seven to fifty-four. The amendment to Article 109, which relates

to the first paragraph of that Article, provides that

a General Conference of Member States for the purpose of reviewing the

Charter may be held at a date and place to be fixed by a two-thirds vote of

the members of the General Assembly and by a vote of any nine members

(formerly seven) of the Security Council.

Paragraph 3 of Article 109, which deals with the consideration of a possible

review conference during the tenth regular session of the General Assembly,

has been retained in its original form in its reference to a "vote, of any

seven members of the Security Council", the paragraph having been acted upon

in 1955 by the General Assembly, at its tenth regular session, and by the

Security Council.

The amended text of Article 23 reads as follows:
(1) The Security Council shall consist of fifteen Members of the United Nations. The Republic of China,
France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern lreland, and the United States of America shall be permanent members of the Security Council. The General Assembly shall elect ten other Members of the United Nations to be non-permanent members of the Security Council, due regard being specially paid, in the first instance to the contribution of Members of the United Nations to the maintenance of international peace and security and to the other purposes of the Organization, and also to equitable geographical distribution.
(2) The non-permanent members of the Security Council shall be elected for a term of two years. A retiring member shall not be eligible for immediate re-election.

The first amended text of Article 61 read as follows:
(1) The Economic and Social Council shall consist of twenty-seven Members of the United Nations elected by the General Assembly.
(2) Subject to the provisions of paragraph 3, nine members of the Economic and Social Council shall be elected each year for a term of three years. A retiring member shall be eligible for immediate re-election.
(3) At the first election after the increase in the membership of the Economic and Social Council from eighteen to twenty-seven members, in addition to the members elected in place of the six members whose term of office expires at the end of that year, nine additional members shall be elected. Of these nine additional members, the term of office of three members so elected shall expire at the end of one year, and of three other members at the end of two years, in accordance with arrangements made by the General Assembly.
(4) Each member of the Economic and Social Council shall have one representative.

The further amendment to Article 61 was adopted by the General Assembly on 21 December 1971 and came into force on 24 September 1973.
The amended text of Article 61,which came into force on 24 September 1973,reads as follows:
(1) The Economic and Social Council shall consist of fifty-four Members of the United Nations elected by the General Assembly.
(2) Subject to the provisions of paragraph 3, eighteen members of the Economic and Social Council shall be elected each year for a term of three years. A retiring member shall be eligible for immediate re-election.
(3) At the first election after the increase in the membership of the Economic and Social Council from twenty-seven to fifty-four members, in addition to the members elected in place of the nine members whose term of office expires at the end of that year, twenty-seven additional members shall be elected. Of these twenty-seven additional members, the term of office of nine members so elected shall expire at the end of one year, and of nine other members at the end of two years, in accordance with arrangements made by the General Assembly.
(4) Each member of the Economic and Social Council shall have one representative.
