事務総長の告示(国連部隊による国際人道の遵守)



事務総長はこのたび、国連部隊による国際人道法の遵守に関して、告示を宣布した。
以下、この告示全文、および、ザックリン事務次長補ブリーフィング論点である。



ザックリン事務次長補ブリーフィング論点

 1999年8月12日、国際社会は、戦争犠牲者の保護に関するジュネーブ4条約*の50周年を迎えます。コフィー・アナン事務総長はこの機会にジュネーブを訪れ、「厳粛なアピール」(“Solemn Appeal”)に署名するとともに、関連する記念行事に参加する予定です。
 アナン事務総長はジュネーブ4条約の50周年記念演説を行います。しかし、それ以上に、事務総長はこれまで長い間、国連部隊に適用される国際人道法の基本原則および規則の策定に関与してきました。この5年間にわたる努力は、きょう発表される文書となって結実したのです。

経緯:

 本件文書の起源は1994年6月にさかのぼります。この時、赤十字国際委員会(ICRC)の指導の下に、専門家グループの会合が開かれ、本文の原案が作成されました。当時、コフィー・アナン氏は平和維持担当事務次長を務めていました。
 それまで、国際人道法の国連に対する適用可能性について何ら正式な文書がなかったのは、単に国連がジュネーブ条約(および関連するその他条約)の当事者ではなかったからです。周知のとおり、平和維持自体が国連憲章で成文化されていないということもありますが、平和維持要員は停戦が確保されてからはじめて現地で活動を展開するため、戦闘状態を取り扱うジュネーブ条約を国連部隊に適用する必要性はないはずだとする理解が一般的だったのです。
 しかし、実際のところ、国連部隊はしばしば、戦闘状態に巻き込まれることがありました。この認識の下、1997年からは、国連と平和維持活動受入れ国の間で締結される「兵力地位協定(SOFA)」に、国際人道法の精神と原則の両方を尊重する義務に関する条項が盛り込まれています。
 ICRCが最初の草案を提出したことを受けて、平和維持活動局と法務室は1995年、共同でそのすりあわせを開始しました。1996年には、兵力提供国との1巡目の協議が行われました。文面はさらに、各国の見解に基づいて調整され、後に平和維持活動委員会に提出されました。
 しかし、この文書は最終的に、事務総長自らの権限で宣布されました。本件文書は個々の平和維持活動要員に対し、現行の慣習法を反映する形で文書中に規定された基準の遵守を義務づけています。
 これらの基準は平和維持活動の発足当初から常時、適用されてきたもので、その執行は常に、加盟国の責務となってきました。本件文書でも、このことに変わりはなく、執行は各国の義務とされています。しかし、この新しい文書は、部隊の司令官に対し、従わなければならない一連の明確な原則と規則を提供するものとなっています。文書はまた、各国政府に対し、自国の軍隊がこれらの原則および規則を遵守することを確保し、違反者は処罰しなければならないことを周知徹底させています。

 事務総長は、国連の指揮と統制の下に作戦を遂行する国連部隊に適用される国際人道法の基本原則と規則を定めることを目的として、以下を宣布する。
The Secretary-General, for the purpose of setting out fundamental principles and rules of international humanitarian law applicable to United Nations forces conducting operations under United Nations command and control, promulgates the following:

第1条
適用範囲
Section 1
Field of application

1.1 本告示に定められた国際人道法の基本原則と規則は、戦闘員として軍事紛争状態に積極的な関与を行っている国連部隊に対し、その関与の程度および期間において適用される。よって、これらの原則および規則は強制行動、あるいは、自衛のために武力行使が許されている平和維持活動において適用される
1.1 The fundamental principles and rules of international humanitarian law set out in the present bulletin are applicable to United Nations forces when in situations of armed conflict they are actively engaged therein as combatants, to the extent and for the duration of their engagement. They are accordingly applicable in enforcement actions, or in peacekeeping operations when the use of force is permitted in self-defence.


1.2 この告示の宣布は、1994年の「国連および関連職員の安全に関する条約」によって保護された平和維持活動要員の地位、あるいは、その非戦闘員としての地位に対して、彼らが国際武力紛争法によって文民に認められている保護を受ける資格を有する限り、影響を及ぼさないものとする。
1.2 The promulgation of this bulletin does not affect the protected status of members of peacekeeping operations under the 1994 Convention on the Safety of United Nations and Associated Personnel or their status as non-combatants, as long as they are entitled to the protection given to civilians under the international law of armed conflict.

国内法の適用
Section 2
Application of national law

 本告示の条項は、軍事要員に対して拘束力を有する国際人道法の原則および規則の網羅的なリストではなく、また、その適用を損なうものでもなければ、軍事要員が作戦中を通じて拘束される国内法に代位するものでもない。
The present provisions do not constitute an exhaustive list of principles and rules of international humanitarian law binding upon military personnel, and do not prejudice the application thereof, nor do they replace the national laws by which military personnel remain bound throughout the operation.

兵力地位協定
Section 3
Status-of-forces agreement

 国連と、国連部隊が展開される領域の国との間で結ばれた兵力地位協定において、国連は、国連部隊が軍事要員の行動に適用される一般的条約の原則および規則を完全に遵守して作戦を遂行することを約束する。国連はまた、国連部隊の軍事要員に、これら国際条約の原則および規則を周知徹底させることを約束する。前述の原則および規則を尊重する義務は、兵力地位協定がない場合でも、国連部隊に適用される。
In the status-of-forces agreement concluded between the United Nations and a State in whose territory a United Nations force is deployed, the United Nations undertakes to ensure that the force shall conduct its operations with full respect for the principles and rules of the general conventions applicable to the conduct of military personnel. The United Nations also undertakes to ensure that members of the military personnel of the force are fully acquainted with the principles and rules of those international instruments. The obligation to
respect the said principles and rules is applicable to United Nations forces even in the absence of a status-of-forces agreement.

Violations of international humanitarian law

 国際人道法に違反した場合、国連部隊の軍事要員は、それぞれの国内裁判所で起訴の対象となる。
In case of violations of international humanitarian law, members of the military personnel of a United Nations force are subject to prosecution in their national courts.

一般市民の保護
Section 5
Protection of the civilian population

国連部隊は何時においても、一般市民と戦闘員、および、民間施設と軍事目標とを明確に識別するものとする。
軍事作戦は、戦闘員と軍事目標のみを対象にするものとする。一般市民あるいは民間施設に対する攻撃は禁止さ
れる。
5.1 The United Nations force shall make a clear distinction at all times between civilians and combatants and between civilian objects and
military objectives. Military operations shall be directed only against combatants and military objectives. Attacks on civilians or civilian
objects are prohibited.

一般市民は本条によって認められる保護を享受するものとするが、敵対行為に直接的に関与している場合は、この限りでない。
5.2 Civilians shall enjoy the protection afforded by this section, unless and for such time as they take a direct part in hostilities.

国連部隊は、一般市民の巻添えによる死亡、一般市民の負傷あるいは一般市民の財産に対する損害を回避し、かつ、発生した場合でもこれを最小限に止めるため、あらゆる実行可能な予防措置を講じるものとする。
5.3 The United Nations force shall take all feasible precautions to avoid, and in any event to minimize, incidental loss of civilian life,
injury to civilians or damage to civilian property.

その作戦区域において、国連部隊はできる限り、軍事目標を人口密集地域の中あるいは近くに設置することを避けるとともに、一般市民の全体および個人、ならびに、民間施設を軍事作戦に起因する危険から守るため、あらゆる必要な予防措置を講じるものとする。平和維持活動の軍事施設および機材は、それ自体としては軍事目標と見なされないものとする。
5.4 In its area of operation, the United Nations force shall avoid, to the extent feasible, locating military objectives within or near densely populated areas, and take all necessary precautions to protect the civilian population, individual civilians and civilian objects against the dangers resulting from military operations. Military installations and equipment of peacekeeping operations, as such, shall not be considered military objectives.

国連部隊は、軍事目標と一般市民を無差別に攻撃する可能性が高い性質の作戦、および、一般市民の巻添えによる死亡、あるいは、期待される具体的かつ直接的な軍事的効果に比して過大な民間施設への損害をもたらしうると見られる作戦の遂行を禁じられる。
5.5 The United Nations force is prohibited from launching operations of a nature likely to strike military objectives and civilians in an
indiscriminate manner, as well as operations that may be expected to cause incidental loss of life among the civilian population or damage to civilian objects that would be excessive in relation to the concrete and direct military advantage anticipated.

国連部隊は一般市民あるいは民間施設に対する報復攻撃を行わないものとする。
5.6 The United Nations force shall not engage in reprisals against civilians or civilian objects.

戦闘の手段と方法
Section 6
Means and methods of combat

6.1  国連部隊が戦闘の方法と手段を選択する権利は、無制限ではない。
6.1 The right of the United Nations force to choose methods and means of combat is not unlimited.

6.2  国連部隊は、関連する国際人道法文書に従い、一定の兵器と戦闘方法の使用を禁止あるいは制限する規則を尊重するものとする。こうした規則には特に、窒息ガス、毒ガスあるいはその他のガス、および、生物学的戦闘方法;人体の内部で容易に爆発、拡張あるいは偏平化する弾丸;ならびに、一定の爆発性発射物の使用
  禁止が含まれる。探知できない破片弾、対人地雷、仕掛け爆弾および焼い弾など、一定の通常兵器の使用も禁止される。
6.2 The United Nations force shall respect the rules prohibiting or restricting the use of certain weapons and methods of combat under the relevant instruments of international humanitarian law. These include, in particular, the prohibition on the use of asphyxiating, poisonous or other gases and biological methods of warfare; bullets which explode, expand or flatten easily in the human body; and certain explosive projectiles. The use of certain conventional weapons, such as non-detectable fragments, anti-personnel mines, booby traps and incendiary weapons, is prohibited.

6.3  国連部隊は、過剰な負傷あるいは不必要な苦痛をもたらしうる戦闘方法、または、自然環境に広範で長期的、かつ深刻な被害を及ぼすことを意図された、あるいは、その可能性がある戦闘方法を用いることを禁じられる。
6.3 The United Nations force is prohibited from employing methods of warfare which may cause superfluous injury or unnecessary suffering, or which are intended, or may be expected to cause, widespread, long-term and severe damage to the natural environment.

6.4  国連部隊は、不必要な苦痛をもたらす性質を有する兵器あるいは戦闘方法を用いることを禁じられる。
6.4 The United Nations force is prohibited from using weapons or methods of combat of a nature to cause unnecessary suffering.

6.5 皆殺しの命令を下すことは禁じられる。
6.5 It is forbidden to order that there shall be no survivors.

6.6  国連部隊は、芸術的、建築的あるいは歴史的記念物、遺跡、美術作品、礼拝の場所、ならびに、各民族の文化的あるいは精神的遺産を構成する博物館および図書館を攻撃することを禁じられる。その作戦区域において、国連部隊はかかる文化的財産あるいはその周囲を、破壊あるいは被害にさらす可能性がある目的に使用しないものとする。文化的財産に対する窃盗、略奪、悪用およびいかなる破壊行為も、厳重に禁じられる。
6.6 The United Nations force is prohibited from attacking monuments of art, architecture or history, archaeological sites, works of art, places of worship and museums and libraries which constitute the cultural or spiritual heritage of peoples. In its area of operation, the United Nations force shall not use such cultural property or their immediate surroundings for purposes which might expose them to destruction or damage. Theft, pillage, misappropriation and any act of vandalism directed against cultural property is strictly prohibited.

6.7 国連部隊は、食糧、作物、家畜および飲用水の給水施設など、一般市民の生存に不可欠な客体を攻撃、破壊、排除あるいは無用化することを禁じられる。
6.7 The United Nations force is prohibited from attacking, destroying, removing or rendering useless objects indispensible to the survival
of the civilian population, such as foodstuff, crops, livestock and drinking-water installations and supplies.

6.8  国連部隊は、危険な力を秘めた施設、すなわちダム、堤防および原子力発電所について、軍事作戦が危険な力の解放と、その結果として一般市民の間に重大な損失をもたらす可能性がある場合、これらを軍事作戦の
  目標としないものとする。
6.8 The United Nations force shall not make installations containing dangerous forces, namely dams, dikes and nuclear electrical generating stations, the object of military operations if such operations may cause the release of dangerous forces and consequent severe losses among the civilian population.


6.9  国連部隊は、本条によって保護される客体および施設に対する報復攻撃を行わないものとする。
6.9 The United Nations force shall not engage in reprisals against objects and installations protected under this section.


第7条
一般市民と「戦線離脱」者の取扱
Section 7
Treatment of civilians and persons hors de combat

7.1 一般市民、武器を放棄した兵士、および、病気、負傷あるいは拘留のために戦線離脱状態に置かれた者を含め、軍事作戦に参加していないか、これを脱退した者は、いかなる状況においても、人間的に、かつ、人種、性別、宗教的信条あるいはその他いかなる理由による差別もなしに、取り扱われるものとする。これらの人々については、その人格、名誉、および、宗教その他の信条を完全に尊重するものとする。
7.1 Persons not, or no longer, taking part in military operations, including civilians, members of armed forces who have laid down their
weapons and persons placed hors de combat by reason of sickness, wounds or detention, shall, in all circumstances, be treated humanely and without any adverse distinction based on race, sex, religious convictions or any other ground. They shall be accorded full respect for their person, honour and religious and other convictions.

7.2 7.1項に言及された者に対しては、何時においても、また、いかなる場所においても、以下の行為は禁じられる。
  生命あるいは身体的保全に対する暴力殺害、ならびに、拷問、手足の切断あるいは何らかの形態の体刑を含む残虐な取扱

7.2 The following acts against any of the persons mentioned in section 7.1 are prohibited at any time and in any place: violence to life or physical integrity; murder as well as cruel treatment such as torture, mutilation or any form of corporal punishment; collective punishment; reprisals; the taking of hostages; rape; enforced prostitution; any form of sexual assault and humiliation and degrading treatment; enslavement; and pillage.

7.3  女性はレイプ、強制売春あるいはその他何らかの形態の卑猥な暴行をはじめとするいずれの攻撃に対しても、特に保護されるものとする。
7.3 Women shall be especially protected against any attack, in particular against rape, enforced prostitution or any other form of indecent assault.

7.4 子どもは特別な尊重の対象とし、いずれの形態の卑猥な暴行からも保護されるものとする。
7.4 Children shall be the object of special respect and shall be protected against any form of indecent assault.


第8条
拘留者の取扱
Section 8
Treatment of detained persons

 国連部隊は拘留された兵士、および、拘留のために軍事作戦に参加できなくなったその他の者に対し、人間的かつその尊厳を尊重した取扱を行うものとする。その法的地位を損なうことなしに、これらの拘留者は、必要な変更を施した上で適用しうるところにより、ジュネーブ第3条約の関連規定に従って取り扱われるものとする。特に、
The United Nations force shall treat with humanity and respect for their dignity detained members of the armed forces and other persons
who no longer take part in military operations by reason of detention. Without prejudice to their legal status, they shall be treated in accordance with the relevant provisions of the Third Geneva Convention of 1949, as may be applicable to them mutatis mutandis. In particular:

(a) その身柄確保と拘留は遅滞なく、同人が属する当事者、および、特にその家族への連絡のために、赤十字国際委員会(ICRC)中央捜索局に通報するものとする。
(a) Their capture and detention shall be notified without delay to the party on which they depend and to the Central Tracing Agency of the
International Committee of the Red Cross (ICRC), in particular in order to inform their families;

(b) これらの者は、すべての可能な衛生・保健手段を備えた確実で安全な家屋の中に収容し、戦闘区域の危険にさらされた場所には拘留されないものとする。
(b) They shall be held in secure and safe premises which provide all possible safeguards of hygiene and health, and shall not be detained in areas exposed to the dangers of the combat zone;

(c) これらの者は、食糧、衣服、衛生および健康管理を受ける資格を有するもとする。
(c) They shall be entitled to receive food and clothing, hygiene and medical attention;

(d)
 これらの者はいかなる状況においても、何らかの拷問あるいは虐待を加えられないものとする。
(d) They shall under no circumstances be subjected to any form of torture or ill-treatment;

(e) 自由を制限された女性は、男性の収容場所とは別の場所に収容されるものとし、その直接の監視は女性が担当するものとする。
(e) Women whose liberty has been restricted shall be held in quarters separated from men's quarters, and shall be under the immediate
supervision of women;

(f) 16歳未満の子どもが敵対行為に直接に参加し、国連部隊によって逮捕、拘留あるいは抑留された場合、これらの者は特別な保護を受け続けるものとする。特に、これらの者は、家族とともに収容される場合を除き、成人の収容場所とは別の場所に収容されるものとする。
(f) In cases where children who have not attained the age of sixteen years take a direct part in hostilities and are arrested, detained or interned by the United Nations force, they shall continue to benefit from special protection. In particular, they shall be held in quarters separate from the quarters of adults, except when accommodated with their families;

(g) ICRCが囚人と拘留者を訪問する権利は、尊重および保証されるものとする。
(g) ICRC's right to visit prisoners and detained Section 10 persons shall be respected and guaranteed. Entry into force


第9条
傷病者および医療・救援要員の保護
Section 9
Protection of the wounded, the sick, and medical and relief personnel

9.1  国連の支配下にある兵士およびその他の者で、負傷したか、病気に罹った者は、あらゆる状況において尊重・保護されるものとする。これらの者は、人間的な取扱を受けるとともに、差別なく、その状況が必要とする医療および看護を受けるものとする。緊急な医療上の理由がある場合のみ、処置を受ける順番の優先が認められるものとする。
9.1 Members of the armed forces and other persons in the power of the United Nations force who are wounded or sick shall be respected and protected in all circumstances. They shall be treated humanely and receive the medical care and attention required by their condition, without adverse distinction. Only urgent medical reasons will authorize priority in the order of treatment to be administered.

9.2  戦場に放置された傷病者および死者の捜索と身元確認を行い、その回収、除去、交換あるいは移送ができるようにするため、状況が許す場合は常に、休戦の取極め、あるいは、その他の局地的な取極めを結ぶものとする。
9.2 Whenever circumstances permit, a suspension of fire shall be arranged, or other local arrangements made, to permit the search for and
identification of the wounded, the sick and the dead left on the battlefield and allow for their collection, removal, exchange and transport.

9.3  国連部隊は、医療施設あるいは移動式医療ユニットの攻撃を行わないものとする。何時においても、これらの施設は尊重・保護されるものとするが、人道的な機能の外、国連部隊に対する攻撃あるいはその他の有害な行為のためにこれらが利用されている場合は、この限りでない。
9.3 The United Nations force shall not attack medical establishments or mobile medical units. These shall at all times be respected and protected, unless they are used, outside their humanitarian functions, to attack or otherwise commit harmful acts against the United Nations force.

9.4  国連部隊は、いかなる状況においても、傷病者の捜索、移送あるいは治療のみを行っている医療要員、および、宗教関係者を尊重・保護するものとする。
4 The United Nations force shall in all circumstances respect and protect medical personnel exclusively engaged in the search for,
transport or treatment of the wounded or sick, as well as religious personnel.

9.5 国連部隊は、移動式医療ユニットの場合と同様、傷病者あるいは医療機材の移送を尊重・保護するものとする。
9.5 The United Nations force shall respect and protect transports of wounded and sick or medical equipment in the same way as mobile medical units.

9.6  国連部隊は傷病者、あるいは、本条で保護される要員、施設および機材に対する報復を行わないものとする。
9.6 The United Nations force shall not engage in reprisals against the wounded, the sick or the personnel, establishments and equipment
protected under this section.

9.7 国連部隊は、いかなる状況においても、赤十字および赤新月の標章を尊重するものとする。これらの標章は、医療ユニット、ならびに、医療施設、要員および機材の存在を表示するか、これを保護する目的以内に用いることができない。赤十字あるいは赤新月の標章の悪用は禁止される。
9.7 The United Nations force shall in all circumstances respect the Red Cross and Red Crescent emblems. These emblems may not be employed except to indicate or to protect medical units and medical establishments, personnel and material. Any misuse of the Red Cross or Red Crescent emblems is prohibited.

9.8
 国連部隊は、親族の傷病者および死者の行方を知る家族の権利を尊重するものとする。このため、国連部隊はICRC中央捜索局の作業を促進するものとする。
9.8 The United Nations force shall respect the right of the families to know about the fate of their sick, wounded and deceased relatives. To this end, the force shall facilitate the work of the ICRC Central Tracing Agency.

9.9 国連部隊は、人道的かつ中立的な性格を有し、何らの差別なく行われている救援活動を容易にするとともに、かかる活動に関与する要員、車両および建物を尊重するものとする。
9.9 The United Nations force shall facilitate the work of relief operations which are humanitarian and impartial in character and conducted
without any adverse distinction, and shall respect personnel, vehicles and premises involved in such operations.

発効
The present bulletin shall enter into force on 12 August 1999.

 本告示は、1999年8月12日をもって発効する。
